Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Tochen.AI’s website (tochen.ai), application (app.tochen.ai), and related products (collectively, the “Services”). By creating an account, connecting integrations, or using the Services, you agree to these Terms.

If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

Tochen.AI is a multi-product automation platform for businesses. Features may include Google Reviews management (reading reviews, drafting AI-assisted replies, and publishing replies per your settings) and additional automations released over time. We may modify, add, or discontinue features with reasonable notice where practical.

• You must provide accurate registration information and keep credentials secure.
• You are responsible for activity under your account and for users you authorize.
• You must comply with applicable laws and third-party terms (including Google’s terms for Business Profile and APIs).

When you connect Google Business Profile, you grant Tochen.AI permission to access data you approve via Google OAuth solely to operate the Google Reviews product—such as listing reviews and posting replies you enable.

You retain ownership of your business content and reviews. You grant us a limited license to process that content to provide the Services. Our handling of Google user data is described in our Privacy Policy, including compliance with the Google API Services User Data Policy and Limited Use requirements.

You are responsible for reviewing AI-generated drafts before publication when you choose manual approval, and for the published replies that reflect your business.

You agree not to:

• Use the Services unlawfully, deceptively, or to infringe others’ rights.
• Attempt to bypass security, scrape unrelated data, or misuse Google API access.
• Upload malware, spam automated replies that violate Google policies, or impersonate others.
• Resell or sublicense the Services except as expressly permitted in writing.

Suggested replies are generated by automated systems and may require your review. Tochen.AI does not guarantee that every suggestion is accurate, complete, or suitable for every situation. You control publishing settings and remain responsible for customer-facing communications you approve or send automatically.

Paid plans, lifetime offers, and pricing are described on our marketing pages and checkout flows. Fees are billed as stated at purchase; taxes may apply. Unless otherwise stated in your plan or required by law, subscriptions renew until canceled. Refund terms, if any, are stated at purchase or in separate commercial agreements.

Tochen.AI owns the platform, software, branding, and documentation. These Terms do not grant you ownership of our intellectual property—only a limited right to use the Services during an active subscription or permitted period.

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or specific business outcomes (such as review ratings or search rankings).

To the fullest extent permitted by law, Tochen.AI and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims relating to the Services will not exceed the amounts you paid us for the Services in the twelve (12) months before the event giving rise to the claim, or one hundred USD if you have not paid fees, unless a higher minimum is required by applicable law.

You will defend and indemnify Tochen.AI against claims arising from your use of the Services, your published replies, your violation of these Terms, or your violation of third-party rights—except to the extent caused by our intentional misconduct.

You may stop using the Services and cancel subscriptions as provided in the app. We may suspend or terminate access for breach of these Terms, risk to the platform, non-payment, or legal requirements. Upon termination, your right to use the Services ends; provisions that by nature should survive (including liability limits and indemnity) remain in effect.

These Terms are governed by the laws applicable to Tochen.AI’s place of establishment, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Courts in that jurisdiction will have exclusive venue for disputes not subject to mandatory arbitration or local consumer rules.

We may update these Terms. The current version will be posted at tochen.ai/terms (and /en/terms) with an updated effective date. Continued use after changes become effective constitutes acceptance where permitted by law.
